Effective Date: January 1, 2026
By using the website located at atwaterasphaltpaving.com, contacting us to request services, or entering into a service agreement with Trueline Atwater Asphalt Paving ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or engage our services.
These Terms and Conditions apply to all visitors to our website, all individuals who request an estimate, and all customers who engage us to perform work. We reserve the right to update these terms at any time. The current version will always be posted on this page with the effective date noted above.
Trueline Atwater Asphalt Paving is an asphalt paving contractor based in Atwater, CA. We provide services including, but not limited to:
All services are subject to a written scope of work agreed upon before work begins. We reserve the right to decline any project at our discretion.
Estimates are provided free of charge and without obligation. An estimate is not a binding contract. Work will not begin until a written scope of work and pricing has been agreed upon by both parties.
Prices are based on conditions observed at the time of the site visit. If conditions discovered during the work differ materially from what was represented or observable at the time of the estimate - for example, a base that requires additional preparation - we will notify you of the change before proceeding and obtain your authorization for any additional cost.
Material prices may change between the time of your estimate and the scheduled start date. If a significant change in material costs occurs before work begins, we will notify you and discuss options before proceeding.
Once a project is scheduled, we will confirm the start date and any access requirements in advance. Schedule changes may be necessary due to weather, material availability, or other factors outside our control. We will notify you as soon as possible if a scheduled date needs to change.
If you need to cancel or postpone a scheduled project, please contact us at least 48 hours in advance. Projects cancelled after mobilization has begun may be subject to a fee to cover costs already incurred.
We reserve the right to reschedule or decline work if site conditions on the day of the job are unsafe or unsuitable for the planned work - for example, heavy rain, extreme heat that would affect the quality of the finished surface, or a site that has not been prepared as agreed.
Payment terms will be stated in your written scope of work or invoice. Unless otherwise agreed in writing:
Invoices not paid within the time specified in your written agreement may be subject to a late fee. We reserve the right to suspend or decline future work for accounts with outstanding balances.
If payment is not received and collection action is required, you agree to be responsible for all reasonable collection costs, including attorney fees, to the extent permitted by California law.
We stand behind our work and aim to deliver a finished surface that meets professional standards. Where a written warranty is provided, it will be stated in your project agreement and will cover workmanship defects under normal use conditions.
No warranty covers damage resulting from:
Asphalt is a durable material, but it requires ongoing maintenance. Regular sealcoating and prompt crack repair are the customer's responsibility and are necessary to preserve the surface life. Neglecting routine maintenance will shorten the useful life of any asphalt installation.
To the maximum extent permitted by applicable law, Trueline Atwater Asphalt Paving is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or your use of our website. This includes, but is not limited to, loss of business, loss of income, or damage to property not directly caused by our work.
Our total liability for any claim arising out of a specific project shall not exceed the amount paid by you for that project. This limitation applies regardless of the basis of the claim - whether contract, tort, negligence, or otherwise.
Before work begins, you are responsible for:
We are not responsible for damage to underground utilities or features that were not disclosed or marked prior to the start of work.

If a dispute arises out of or relates to these Terms, our services, or any agreement between us, we encourage you to contact us first so we can work toward a resolution directly. Most concerns can be resolved with a conversation.
If a dispute cannot be resolved informally, the parties agree to attempt good-faith mediation before pursuing litigation. If mediation does not resolve the matter, disputes shall be resolved through binding arbitration in Atwater, CA, in accordance with the rules of the American Arbitration Association, unless both parties agree in writing to a different process.
You agree that any claim must be brought in your individual capacity and not as part of a class action or representative proceeding.
These Terms and Conditions and any disputes arising from them are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the courts of Merced County, California.
